Bankruptcy: Corporate Restructuring and Chapter 11

The Law Offices of Kenneth A. Reynolds, Esq., P.C. focuses on assisting our clients strategically restructure their business operations through Chapter 11 reorganization proceedings. We evaluate and assess, on a case-by-case basis, whether bankruptcy and corporate restructuring would be beneficial to each potential debtor.

We have represented numerous corporations, both large and small, as well as high net worth individuals, in the reorganization and restructuring of their personal affairs and/or business operations. We have handled matters involving debtor in possession financing transactions, contested matters, adversary proceedings, lender liability issues, Section 363 asset sales, involuntary proceedings, negotiations with secured and priority creditors, and bankruptcy mediation.

Bankruptcy: Consumer Filings Chapter 7 and Chapter 13

In addition to corporate clients, we assist individuals in evaluating and filing Chapter 7 or 13 proceedings.

Chapter 7
Qualified debtors that file a Chapter 7 proceeding seek to eliminate debt without making payments to their creditors. A Chapter 7 proceeding is ideal for those with a large number of credit cards, medical bills, deficiency judgments, auto repossessions, releasing frozen bank accounts, collection debts and are looking to discharge their debts and start fresh. Chapter 7 is not right for everyone, and qualifying as a Chapter 7 debtor is sometimes problematic. At The Law Offices of Kenneth A. Chapter 13
Those wishing to file a Chapter 13 bankruptcy proceeding seek the confirmation of a Chapter 13 plan to satisfy their debts by re-paying their creditors a percentage of their claims. A Chapter 13 proceeding can also offer many benefits such as stopping foreclosure actions, reinstating and curing mortgage claims, removing second mortgages, and retaining debtor’s otherwise non-exempt assets. A debtor in Chapter 13 retains full possession and control over all of their assets.

Kenneth A. Reynolds primarily practices in the areas of bankruptcy and creditor's rights. Mr. Reynolds has gained a broad range of experience in all aspects of bankruptcy and creditor's rights by providing services to both financially distressed business entities and creditors of insolvent businesses. Mr. Reynolds regularly represents corporate and individual debtors in reorganization (Chapter 13 and 11) and liquidation proceedings (Chapter 7), and has extensive experience in representing both secured and unsecured creditors, including airline service companies, landlords, leasing companies, lenders, creditor committees, and bankruptcy trustees.

Mr. Reynolds has been involved in numerous U.S. airline and aviation chapter 11 cases and has made presentations on bankruptcy issues impacting airport ground handling companies and freight forwarding companies at the National Government Affairs Conference and for the National Air Transportation Association. Mr. Reynolds received his law degree and graduated, magna cum laude, in 1992 from the Jacob D. Fuchsberg Law Center at Touro College.

He was admitted to the New York State Bar in 1993, and to the Federal District Courts for the Eastern, Southern, Western, and Northern Districts of New York. Mr. Reynolds is a member of the New York State Bar Association and the Nassau County Bar Association (Bankruptcy Committee).
